These Terms & Conditions ("Terms") govern your use of Kupa (the "Platform"), operated in Zimbabwe. By creating an account, browsing, reserving a Store Deal, or posting or claiming a Giveaway, you agree to these Terms. If you don't agree, please don't use Kupa.
1. What Kupa is
Kupa is a marketplace that connects (a) local food businesses with surplus stock to shoppers, via reservable "Store Deals," and (b) neighbours who want to give away items for free or nearly-free, via "Giveaways." Kupa is a facilitator, not a party to the underlying transaction. The business (for Store Deals) or the giver (for Giveaways) is solely responsible for the item, its description, its condition, and fulfilling the exchange.
2. Accounts
You must provide accurate information when signing up and are responsible for activity on your account. You must be old enough to form a binding contract under Zimbabwean law to use Kupa. We may suspend or terminate accounts that violate these Terms, abuse other users, or engage in fraud.
3. Store Deals
- Reserving a Surprise Bag holds it for collection within the stated window; arrive on time. Late or missed collections ("no-shows") may result in a strike on your account.
- Payment is either cash on collection or online at checkout, depending on what the business accepts. Online payments for Store Deals are processed directly to the business's own payment account. Kupa does not hold or take custody of that money.
- Businesses are solely responsible for the quality, safety, and accurate description of the food they list, and for complying with applicable food-safety regulations. Kupa does not prepare, inspect, or handle any food sold through the Platform.
- Refunds and disputes about a Store Deal are between you and the business; contact them directly, or reach out via Report a problem if you need help.
4. Giveaways. Please read carefully
Kupa does not verify, inspect, test, or endorse any item listed as a Giveaway.
Listings are created entirely by other users ("givers"). We do not check that an item is safe, accurately described, legal to give away, or in the condition stated. You are responsible for inspecting and satisfying yourself about an item before you accept it. Check its condition, ask questions, and use common sense (meet in a well-lit, public place; bring a friend if unsure; never share sensitive personal or financial information).
Kupa is not a party to, and assumes no responsibility or liability for, any Giveaway transaction. To the fullest extent permitted by law, Kupa disclaims all liability for any injury, illness, loss, damage, or dispute arising from a Giveaway item or an interaction between a giver and a claimant, including but not limited to the item's condition, safety, hygiene, fitness for purpose, or legality. You use Giveaways entirely at your own risk.
Givers must only list items they lawfully own and are entitled to give away, and must describe them honestly. Claimants and givers are each responsible for arranging a safe pickup. If something seems off about a listing or a person, use Report a problem so we can review it.
5. Prohibited items & conduct
You may not list or request anything illegal, unsafe, counterfeit, stolen, or that infringes someone else's rights, including (without limitation) alcohol or tobacco to minors, prescription medication, weapons, hazardous materials, live animals in distress, or expired food unsafe for consumption. You may not harass, defraud, or misrepresent yourself to another user. We may remove listings or accounts that breach this section without notice.
6. Fees
Shoppers never pay Kupa a fee to browse or reserve. Businesses selling Store Deals may be charged a commission on completed sales (shown in their vendor dashboard, currently around 5% unless a promotional free period applies); Kupa collects this separately from a business's prepaid wallet, not from the shopper's payment. Giveaways are always free to post and free to claim.
7. Limitation of liability
To the maximum extent permitted by law, Kupa and its operators are not liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform, or from any Store Deal or Giveaway transaction, even if advised of the possibility of such damages. Kupa's total liability for any claim relating to the Platform is limited to the greater of (a) fees you paid to Kupa in the 3 months before the claim, or (b) USD 50. Nothing in these Terms excludes liability that cannot lawfully be excluded.
8. Changes
We may update these Terms from time to time; continued use of Kupa after a change means you accept the updated Terms. We'll update the "Last updated" date above when that happens.
9. Governing law
These Terms are governed by the laws of Zimbabwe.
